Terms of Service

These Terms of Service (“Terms”) govern your use of marketmindsglobal.com and any services provided by Market Minds Global (“Company”, “we”, “our”, or “us”). By accessing the Website or purchasing a subscription, you agree to be bound by these Terms.

1. Service Description

Market Minds Global provides a monthly website-as-a-service (WaaS) subscription for licensed electricians and electrical contractors. The service includes the design, development, hosting, and ongoing management of a professional website, along with local SEO optimization, review generation system setup, and monthly analytics reporting, as described on our Services page and in the subscription agreement you receive at sign-up.

Specific deliverables and scope are confirmed at onboarding. Any additional services not outlined in the standard subscription require a separate written agreement.

2. Eligibility

You must be at least 18 years old and have legal authority to enter contracts on behalf of yourself or your business. By agreeing to these Terms, you represent that you are a licensed or registered electrical contractor or business operating in a lawful manner in your jurisdiction.

3. Payment Terms

The standard subscription fee is $497/month, billed monthly. Your first payment is due after your website is built, reviewed, and approved by you. Subsequent monthly payments are automatically billed on the same day each month.

There are no setup fees, activation fees, or long-term commitments. All prices are in USD.

If a payment fails, we will notify you by email and attempt to recharge within 5 business days. Accounts more than 14 days past due may be suspended until payment is received.

4. Cancellation Policy

You may cancel your subscription at any time by providing written notice (email to hello@marketmindsglobal.com) at least 30 days before your next billing date. You will retain access to all services through the end of your current paid billing period.

There are no cancellation fees. No long-term contracts. Upon cancellation, your website will be taken offline unless you have made alternative hosting arrangements with us in writing.

We reserve the right to terminate service immediately for any violation of these Terms, including non-payment or misrepresentation of your business.

5. Lead Guarantee

Market Minds Global offers a performance guarantee: if your website does not generate at least 5 qualified inbound leads within your first 60 days of service, we will continue providing the service at no additional monthly charge until the 5-lead threshold is met.

The following conditions apply to the guarantee:

• A “qualified lead” is defined as a contact form submission or inbound phone inquiry from a potential customer within your service area seeking electrical work.
• The guarantee applies to new customers only and to the first 60 days of active service following website launch.
• The guarantee is void if you cancel service during the 60-day period, fail to provide accurate business information during onboarding, or significantly restrict the service area to fewer than 3 cities.
• The guarantee covers only the monthly service fee. It does not cover any external advertising spend, third-party tools, or custom development fees.

6. Intellectual Property

All custom website content, design, copy, and graphics created by Market Minds Global are the property of Market Minds Global until your subscription is fully paid up. Upon continued subscription or a completed agreed-upon buyout, you retain a license to use the content while your subscription is active.

If you cancel your subscription, we will remove the website from our hosting infrastructure. You may request a content export (text and images) for a one-time fee of $149 within 30 days of cancellation.

You are responsible for ensuring that any materials, logos, or information you provide to us do not infringe on any third-party intellectual property rights.

7. Your Responsibilities

As a client, you agree to:

• Provide accurate business information during onboarding and update us promptly if it changes
• Respond to design review requests within 5 business days to avoid delays
• Not use the website to promote unlawful services or misleading claims
• Not attempt to gain unauthorized access to our systems or infrastructure

8. Limitation of Liability

To the maximum extent permitted by applicable law, Market Minds Global shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, business, or data, arising out of or related to your use of our services — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of these Terms or your use of the services shall not exceed the total amount paid by you to us in the 3 months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow limitation of liability for personal injury or certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

9. Disclaimer of Warranties

The service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, except as stated in Section 5 (Lead Guarantee). We do not warrant that the Website will be uninterrupted, error-free, or that search rankings will reach any specific position. SEO results depend on many factors outside our control, including search engine algorithm changes.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising out of these Terms will be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Volusia County, Florida, under the rules of the American Arbitration Association.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the “Last Updated” date above. Material changes will be communicated by email to active subscribers at least 14 days before taking effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
